  1. Introduction / Definitions

 

This website, found under the www.yummyhome.co.uk URL, is operated by Yummy Home Ltd and references to “we”, “us” and “our” shall be deemed to be references to Yummy Home. References to “you” and “your” shall be deemed to be references to person placing an order via this website.

 

Please read these terms of sale carefully. You will be asked to expressly agree to these terms of sale before you place an order for products from our website.

2.  Order Process

By placing an order via this website you will be deemed to have read, understood and agreed to these terms and conditions.

All goods are subject to acceptance and to availability of the goods and we are entitled to refuse any order placed by you.

 

You undertake that all details provided by you for the purpose of purchasing goods through this website are correct.

 

Once you have placed an order we will send you a confirmation that your order has been received but this is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and Yummy Home for the sale of our products will only exist once an order has been accepted, processed and despatched to you.

 

Prices and availability of goods are subject to change without notice.

 

3. Products

Yummy Home takes every effort and care to ensure that the description and detail on this website are correct at the time of uploading this to the website. However, the specification and descriptions of products is intended to give a general description only. Furthermore, we cannot accept responsibility in any variation in colour between the image on the website and the actual product.

 

4. Price and Taxes

 

All prices on our website are in pounds sterling and are inclusive of VAT at the current rate. Yummy Home reserves the right to change prices without prior notice.

 

If your order is being despatched to a destination outside the European Union then your sales tax will be zero. If your order is being sent to a member state for the EU then the selling price will include VAT at the current rate. Any customs or import duties levied once the package reaches your destination country will be your responsibility.

 

5. Payment

 

Online payments can be made using all major credit or debit cards except AMEX. You will be required to confirm that the card being used is yours. The payment will be cleared from your account before the despatch of your products. All payments are subject to validation checks and we may share your personal information with such parties that enable us to do these checks. If you refuse such checks, this may lead to delay or non-delivery of goods for which we will not be liable.

 

6. Return Policy

 

You may cancel a contract to purchase a product or products at any time within 7 working days after the day you received the relevant product or products subject to the limitations set out below.

 

  • If you cancel an order on this basis, you must inform us in writing and return the product or products to us immediately, in the same condition in which you have received it or them.

  • We will not refund the outgoing postage cost to you.

  • Product or products returned by you in accordance with this section will be refunded in full. However, you will be responsible for paying the cost of returning the product or products to us and responsible for ensuring the products are packaged in an appropriate manner

  • We cannot be responsible for interest charges made by your credit card company whilst waiting for returns to be refunded to your card.

 

Please ensure when returning any item you enclose a copy of your original invoice, wrap well and send to;

We will refund the costs of postage where the item returned is faulty, please provide photographic evidence of any faulty goods and ensure that the delivery is signed for as 'damaged' if there is visible damage to the outer delivery carton.

In all above cases, we will process the refund due to you within thirty (30) days of receipt of the product or products. However, no refunds or exchanges are available on Body and Bath Products and Special Orders. This does not affect your statutory rights.

 

7. Delivery Policy & Process

 

We will arrange the products to be delivered to the address for delivery indicated in your order. We will use reasonable endeavours to deliver products on or before the date for delivery set out in our order confirmation or, within seven (7) days of the date of our order confirmation. We do however guarantee that unless there are exceptional circumstances all deliveries of products will be dispatched within thirty (30) days of the later of receipt of payment and the date of our order confirmation. In the event that an item is temporarily out of stock, we will notify you of the delay and despatch it as soon as it arrives. We only deliver products within the United Kingdom unless special order arrangements have been made. Refer to our Delivery Policy for details of charges and time frame.

 

Our aim is to despatch any order received by 5pm, within 48hrs, except for the exceptionally busy periods of the year when we will advise accordingly.

AM (Orders must be received by 10am day before) @ £7.95

Before 9AM (Orders must be received by 10am day before) @ £12.95

8. Warranties

 

Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness and accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up to date to the maximum extent committed by applicable law we exclude all representations, warranties and conditions relating to this website and to the use of this website.

 

Yummy Home is not liable for your use of any other websites which you may access via links within our website. Yummy Home does not control the links and contents of these websites.

 

9. Risk and Ownership

 

Delivery is deemed to take place when the goods are delivered to the nominated address where upon the risk of loss, breakage and any damage will pass to the customer.

 

Title in the goods does not pass to the Customer until payment is received by Yummy Home.

 

We will be entitled to recover payment for the products even where ownership has not passed to you.

 

10. Limitations of Liability

 

Nothing in the terms of sale will

 

i.                    Limit or exclude the liability of a party for death or personal injury resulting from negligence

ii.                  Limit or exclude the liability of a party for fraud or fraudulent misrepresentation by that party.

iii.                 Limit or exclude of a party under section 12, 13, 14 or 15 of the Sales of Goods Act 1979 or Part I of the                       Consumer Protection Act 1987.

iv.                 Limit any liability of a party in any way that is not permitted under applicable law

 

or

 

v.                   Exclude any liability of a party that may not be excluded under applicable law.

 

Any statutory rights which you have as a consumer, which cannot be excluded or limited, will not be affected by the terms of sale.

Yummy Home will not be liable to you in respect to any losses arising out of any events or series of events beyond our reasonable control.

 

11. Health and Safety

 

In accordance with the Health and safety at Work Act 1974 and the Consumer Protection Act 1987, Yummy Home confirms that, when the goods they supply are properly used as designated with reasonable precautions they do not present a hazard to health and safety.

 

12. Indemnity

 

You hereby indemnify Yummy Home and undertake to keep Yummy Home indemnified against any losses, damages, costs, liabilities and expenses, including without limitations legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisors, incurred or suffered by Yummy Home arising out of any breach by you of any provision of these terms of use, or arising out of any claim that you have breached any provisions of these terms of use.
